A judge reached his limit during a heated dispute over a dog named Ziggy, scolding both the original owner and the current caregiver for wasting court time over a Facebook giveaway that lacked any formal contract.
The small claims hearing highlighted the legal complications that arise when pet owners rehome animals informally through social media without clear, written agreements.
The Facebook Rehoming Agreement
The dispute involved plaintiff Zach Sylvester, the founder of “Zach’s K9 Companions,” and defendant Kelly Lounsbury.
Sylvester originally rescued Ziggy, a mixed-breed dog, in late 2024. Because Ziggy did not get along with Sylvester’s other pet, Sylvester posted a free rehoming ad on Facebook.
In June 2025, Lounsbury answered the ad and took Ziggy into her home, where the dog remained for over a year.
However, Sylvester filed a claim to repossess Ziggy, arguing that his initial agreement was conditional. Sylvester claimed he offered Lounsbury custody only on the condition that he retained legal ownership, remained active in the dog’s life, and could reclaim Ziggy if Lounsbury became unable to care for him.
Sylvester presented records from Animal Control and a local humane society from 2024 listing him as Ziggy’s registered owner, alongside text messages showing Lounsbury previously asking him to take the dog back when she faced financial and behavioral challenges.
“I have documentation from Animal Control stating that I am his owner,” Sylvester argued. “I’ve had to buy Ziggy dog food on a couple of occasions… She has no income to take care of him, has asked me to rehome him, and I found a suitable home for him.”
“He Thinks He’s Animal Control!”
Lounsbury countered that Sylvester was attempting to control her household, alleging that he used threats of police and animal control intervention to force her to surrender the dog.
She testified that while she permitted Sylvester to walk Ziggy occasionally, she revoked those privileges after Sylvester’s other dog reportedly attacked Ziggy. Lounsbury argued that Sylvester gave her the dog permanently through the public Facebook post and had no legal right to dictate her life.
“Zach has no right… he thinks he’s Animal Control! Like he’s God!” Lounsbury fired back. “This is my dog. He’s been a service dog to me… I got him off a free post on Facebook.”
“You Have No Contract”: Judge Rules on Ownership
As both parties repeatedly interrupted each other and argued over text messages, the judge stepped in to dismantle their legal arguments.
Addressing Sylvester, the judge pointed out that official paperwork from 2024 predated the rehoming agreement and proved nothing about current ownership. The judge rejected Sylvester’s claim that he could act as a self-appointed welfare agency to repossess a pet whenever he deemed fit.
“Mr. Sylvester, it sounds to me like you’re acting like Animal Control,” the judge noted. “What legal right do you have to have the dog back after you gave it away? … This is not a child where I look at the best interest of the dog. You realize this is why we have contracts, right?”
Turning to Lounsbury, the judge reprimanded her for failing to establish formal vet records or written proof of ownership during the entire year she cared for Ziggy.
“Both of you are making fools of yourselves because you’ve got no contract about a dog!” the judge admonished. “If it’s going to be this important that you’re going to go to court over it, it’s important enough to have a contract. It’s important enough to take the dog to the vet.”
Ultimately, because Sylvester voluntarily surrendered physical possession of Ziggy over a year prior without a binding retention of rights, the judge ruled that Sylvester has no legal claim to the dog and declared Ziggy belongs to Lounsbury.
The judge ordered Lounsbury to immediately register Ziggy with a veterinarian to establish a proper paper trail, commanding both parties to sever all contact permanently.
