Legal proceedings concluded in a San Joaquin County courtroom following the sentencing of a former licensed residential daycare operator in connection with the alcohol-fueled neglect that led to the death of five-month-old Christian Olvera.
Roxanne Helus, 49, owner and operator of Cherished Years Daycare in Manteca, was sentenced to six years in state prison after pleading guilty to felony child abuse and endangerment, involuntary manslaughter, and misdemeanor driving under the influence (DUI).
The court also ordered Helus to pay $12,818 in restitution to Christian’s family, along with an additional $3,327.22 distributed among the families of the five other young children entrusted to her care on the day of the incident.
Timeline of Caregiver Neglect
According to court filings from the San Joaquin County District Attorney’s Office, the incident occurred on October 22, 2025. Investigators established that Helus began consuming alcohol as early as 4:00 a.m. while responsible for six children.
While intoxicated, Helus drove two children to school. She subsequently ordered over $100 worth of alcoholic beverages to be delivered directly to the daycare property.
Around 11:30 a.m., Helus brought five-month-old Christian into an unauthorized travel trailer on the premises, where she continued drinking. During this period, the infant experienced an acute medical emergency. Due to Helus’ extreme intoxication—later measured at a blood alcohol concentration (BAC) of 0.29%, more than three times the legal driving limit—she failed to recognize the gravity of the situation or call for immediate emergency medical intervention.
By the time first responders arrived at the scene, the infant was unresponsive. Christian was rushed to Oakland Children’s Hospital, where medical teams attempted life-saving measures. Tragically, after two days on intensive life support, Christian succumbed to an anoxic brain injury caused by prolonged oxygen deprivation. Prosecutors emphasized that every minute of delayed emergency response directly compromised the child’s probability of survival.
Judicial Accountability and Advocacy
During the plea proceedings, Helus admitted to the aggravating factor of abusing a position of trust and confidence owed to the parents who relied on her licensed facility.
District Attorney Ron Freitas commented on the resolution of the case:
“Parents place immense trust in childcare providers to protect their children. When that trust is violated through reckless and criminal conduct, especially when it results in the death of a child, our office will pursue accountability.”
